On the Center

We are pleased to introduce the revival of our activity with the title "Expert support of West-Russia dialogue”.
The Center is a group of independent experts, mostly but not exclusively Russian,  working both inside and outside  the country...

The Center exists as a virtual ground since April, 2014.

Civil control: public and parliament commissions, independent prosecutors

Civil control of law enforcement agencies and state's first persons, of human rights, executing laws and their correlation to accepted international agreements and conventions exists in any democratic society. Such control is exercised via the independent and parliament commissions, institute of independent prosecutors and Commissioner for Human Rights. The Center's experts as members of the independent commissions deal with the resonance having criminal cases and this work of out-of-system institutions is almost single in Russia possibility to move the needed process of criminal legislation humanization in economic sphere from the "dead point".

Симпозиум "Уголовная политика и бизнес"

April 2012. Roundtable “Criminal Policy’s Impact on the Economics”

The roundtable “Criminal Policy’s Impact on the Economics” took place on April 4, 2012 in the mainframe of XIII April International Academic Conference on Economic and Social Development held by Higher School of Economics. Center of Legal and Economic Studies experts, together with invited lawyers, economists and other experts discussed the growing pressure of Russian law enforcement bodies on business, intensification of legislations’ repressive functions in economic sphere. In Russia every sixth business is prosecuted and this fact influences the speed of economic development, but changes of that practice are impossible if the practicing lawyers inside the law enforcement system and officials of the State bodies will not be interested in the reform.

Humanization of criminal legislation in economic sphere is one of the most important questions in the Center of Legal and Economic Studies' agenda. These days in modern Russia criminal prosecution becomes the global instrument of the State's pressure on businessmen and the way to manage the economy, it gives birth to emigration moods in society and seriously worsen the investment climate.

Amnesty of businessmen must be the first step on the way of criminal legislation in economic sphere humanization, that is the only measure that can may improve the country's investment climate and recover the business comunity's trust to the state. Today more than 100 000 people are held in prison who are convicted for economic crimes, every sixth businessmen is criminally prosecuted, a lot of cases brought into action "in the absence of injured". Significant number of businessmen are imprisoned for ordered cases that are used as instrument to take property away. Refuse to change the crinimal policy toward business will mean that the State tryes to build "market economy without businessmen".

Over-criminalization and the need of legislative reform.




The Center for Legal and Economic Studies is organization established in 2010 by a renowned group of Russian legal experts and economists, including former justices of the highest judicial bodies in Russia. The Center seeks to support the development of the rule of law in Russia, with an emphasis on reducing the abuse or misuse by state officials of criminal law as it is applied to entrepreneurial activity.

The experts affiliated with the Center have published a collective monograph entitled “Rule of Law in Russia - Issues of Implementation, Enforcement and Practice”. The monograph was published in Russian (2009) and English (2010) by Statut Publishers. In 2010, the Center developed a Concept for the Development of the Russian Criminal Code Chapter on Business Crimes, as well as a set of proposed amendments to the Code. On September 16, 2010, the Center presented the Concept at the public hearings in the State Duma.

The Center is now providing expert advisory support to both the Presidential Administration and the State Duma (Parliament) of the Russian Federation on an ongoing basis.
